If you’ve ever been tempted to buy or sell a property without the help of a licensed real estate agent, my advice is DON’T!

I’ve been a landlord for more than 30 years, and was a real estate agent for 4 years, and there’s no way I’d buy or sell without a REALTOR…. in large part because I know what can go wrong.   Real estate agents must – by virtue of their license – stay on top of all the laws and their various changes and permutations that affect real estate transactions, and believe me – there are a lot of them.

Sure, you can save a few thousand dollars by not using a licensed agent, but it’s not worth the risk.

Years ago I knew someone who decided that plumbing couldn’t be all that hard, so he decided to fix his toilet all by himself.  A week later, I finally called Jerry the plumber.  Jerry took one look, slowly shook his head and said in that very Downeast drawl he had… “Linda, don’t ever let that guy near a toilet again”.

A half hour job had been turned into a week of no toilet and a two hour fix.

It’s sort of the same with real estate, except the risk is oh so very much greater.

I hope you’ll take time to scan the scenario below that my husband, John Snyder, was involved in, as the court appointed property manager.  Had he been brought in years – or even months – before he actually was, the whole thing might have turned out differently.As an accountant (lawyer, banker, mortgage professional), you likely have one or two clients who give you that uneasy feeling, especially if there’s a divorce or partnership breakdown involved.Bringing in a professional like John could save a lot of heartache and financial problems.

The Situation:

In October 2011, On the Spot Property Management was appointed by the Court to manage a boarding home complex of several dozen units.  It was a divorce case that had dragged on for years, with the judge eventually realizing that the spouse who had been managing the real estate couldn’t account for either the income or the expenses of the buildings, which were joint marital property.

That spouse also insisted that the buildings had been barely breaking even for years, and that the significant credit card bills and “shareholder loans” totaling nearly $40,000 attached to the LLC were the only way to keep those buildings running.

The Court appointment was supposed to be for just three months, but the case continued for more than a year beyond that, until spring of this year.

During that year and a half, On the Spot Property Management was reimbursed for 10% of the collected rents, as well as $45 per hour for such tasks as handling bed bug issues, water and furnace failures, lockouts, public safety calls, evictions, and so forth.  On the Spot’s monthly fee varied from around $1,100 per month to over $2,000 at times, averaging about $1,500 monthly.

Yet even with the additional expense of On the Spot’s fees, the buildings were still breaking even during those 18 months, even with the initial problems of little money in reserve, bills that had gone unpaid, and a heating season having just started…. and even though the managing spouse insisted that the properties were losing money (although he had no records to prove his contentions).

The managing spouse didn’t even provide receipts to his tenants for rents paid nor did he keep other income records, so it was impossible to determine how much money had in fact been collected over the previous decade.

Over the next 18 months, On the Spot Property Management found that the entire infrastructure of the three buildings was shot.  The furnaces had been illegally patched, the plumbing and wiring didn’t meet code, and other neglected issues continued to rear their ugly little heads.

Eventually it was determined that the mechanical systems of one building were in such disrepair that they would cost at least $25,000 to fix – and there was no money to do so.  The building had to be closed, and the tenants relocated.

So where had the money gone?

Of course, everyone involved knew, but by the time On the Spot was appointed to manage the properties, it was too late.  The money was gone, the needed repairs had not been made, and the properties were deep in debt.  What was supposed to have been the children’s college fund was now less than worthless.

Had On the Spot Property Management gotten involved years before, the buildings almost certainly would have been salvaged, credit ratings wouldn’t be in the toilet, and there would have been savings for the kids.

A 203k Loan is one of the most exciting and misunderstood loan products available.  The popularity of this product has exploded around the country but the 203k is not being utilized to its potential in Maine.

I am Dan Link, a certified 203k Consultant certified by the U.S. Department of Housing and Urban Development. (HUD)  I teach classes to realtors around Maine on the subject of 203k loans.  It is really a simple concept but most realtors are afraid or feel it is too difficult.  Nothing could be farther from the truth.

Many Realtors will not hesitate to help their clients to finance a home using a traditional FHA loan.  HUD calls that a 203b type loan.  A 203k loan (also an FHA type loan) is virtually no different than a 203b loan except that it has a construction component.  That means you have to get a quote from a contractor to do the work and submit it to the lender.  Otherwise they are the same.  The extra paperwork associated with the loan is mostly associated with the contractor and his bid.  If a buyer qualifies for a traditional FHA mortgage, then they will have no problems qualifying for a 203k loan.

The real secret to making 203k loans work is to make sure you have the right players on the team.  A good 203k team has a lender experienced in 203k loans, a realtor who understands the process, a contractor who is chosen by the borrower and approved by the lender and a good 203k consultant.  With a team like that, the entire process is smooth and fast.

Good Things Come from Being Chosen as the Designated Non-Profit at a Maine Real Estate, Housing & Land Use Conference

As someone who’s always worked at least two jobs, or has worked for someone else while also running my own business, I figure that all told, my 40 year work career actually adds up to about 80 years of experience.  And since at least 30 percent of my career has been in the non-profit world (not to mention all of the years serving on non-profit boards), that means I have a good few decades or more in furthering the goals of not-for-profit organizations.

(Plus, for 10 years I ran a for-profit social services agency – we had essentially the same funding mechanisms as the non-profits, but with the disadvantages of being unable to get grants and donations, while also having to pay income, sales and property taxes.)

This means that supporting non-profits is second nature to me, even though my primary business is “for profit”.

And that means that we try to actively help non-profits with similar goals as our conferences.

A few months before each Real Estate, Housing & Land Use conference we publish Requests for Proposals from agencies providing food, clothing and shelter.  It’s a simple, one-page RFP; having worked as a grant proposal writer, I know how much work it can be, and sometimes for no results at all.

Agencies applying for Designated Non-Profit status are then rated on items that help our committee determine whether the organization meets our criteria.  The scoring grid looks like this – you’ll have to click on the diagram to view it more easily:

The agency with the highest number of points earns our Designated Non Profit Status.

What that gives them is

  1. a free exhibit booth
  2. the option of having conference attendees donate above the cost of their registration fee to the agency
  3. the ability to ask for donations during the event, and
  4. a 3-minute self-introduction prior to the keynote presentation.

Also, we often need volunteers to help with our conferences, and will donate $10 per hour of approved volunteer time to the exhibiting non-profit of that volunteer’s choice… so there’s another possible donation.  And, we’ll help that non-profit develop a fund-raising project specific to their participation in our conference.

From our perspective, it’s all about being a good neighbor.  Don’t you agree?

A Widespread Email Glitch? Holy Black Hole, Batman!

10/18/2013.  UPDATE and ARGH!!  Yesterday we learned that a significant percentage – as high as 50% or more – of the thousands of emails we’ve sent out every couple of weeks regarding the conference never made it to the intended recipients – and that the problem is widespread throughout the Bangor area, and perhaps even beyond.  Phone calls to dozens of people yesterday confirmed this, and we’ve been asked to please re-send the information on the Bangor Area conference.  (We have no idea if this is confined to the Penobscot area, or if it’s hitting further south and east.)

As a result, so many people have not only missed the Early Bird Rate, but haven’t gotten anything from us, that we’re redoubling our efforts to get the information out to everyone…. AND we’re reducing our prices.  Ordinarily the Early Bird Rate would be long gone by now, but we’re reinstating it until October 24 at midnight.  And we’ve reduced the Last Minute Ticket pricing to our regular price rather than the higher rate needed to cover last minute expenses.  This seems the only fair way to handle such a difficult situation.

So if you see inconsistencies in our prices anywhere, please make allowances – it’s an awful lot of work to go back and find all the changes that must be made, especially during the final few weeks leading up to a conference.

The John F Murphy Homes, Inc, which for 35 years has offered life-enriching activities to people with developmental disabilities and autism spectrum disorder, has been awarded Designated Non-Profit status at the November 8 Greater Androscoggin Real Estate, Housing and Land Use Conference, to be held at the Ramada Inn & Conference Center. 

John F Murphy Homes (JFM) will receive a free exhibit space at the conference giving staff and organization members the opportunity to meet with area real estate, housing and other professionals, and sell tickets to future events that help support the agency’s services.   JFM will also precede the keynote speaker during the lunchtime program, giving attendees an overview of the agency’s proud history of service in our community. 

JFM operates 54 local residential facilities, several day programs and the Margaret Murphy Children’s Centers.

If you’ve delayed buying your tickets to either the Greater Bangor Real Estate, Housing & Land Use Conference with Trade Show (Oct 31-Nov 01) or the Greater Androscoggin Real Estate, Housing & Land Use Conference (Nov 08), this weekend is the time to buy!For just 48 hours, from 12:00 noon on Saturday, October 12 to 12:00 noon on Monday, October 14, all tickets, exhibit spaces, sponsorships and conference program ads are at least 16% off… that’s one heck of a savings!  And there are other specials, too.Here’s the scoop on tickets….

Deal #1.  One day conference tickets to either the Bangor or the Androscoggin conference are presently $89 (and a few days before the events will increase because of the logistics of working with our venues, ordering food and so forth).

For 48 hours, we’ll knock 16% off those 1-day tickets, bringing the price down to $74.76, saving you $14.24 per person.  We’ll do the same for all of the other conference tickets, too… so in Bangor, two days that would ordinarily be $139.00 will be $116.76… saving you $22.24!

Deal #2.  If your office buys tickets for 4 people, one additional person will get to attend for free!  That’s a 20% savings – or $17.80 in savings per person!  (That means that if 5 people from the same office were to attend the entire Bangor conference, it’s a total savings of $189.00 – or $37.80 saved per person .. not too shabby.)

Deal #3If you’ve already bought your ticket, and can sign up another person to attend, we’ll refund you 20% off your ticket price… and will do that for every single person you sign up.  (So sign up 5 people, and get in for free!)

Now, for sponsorships, exhibit spaces and conference program ads…The deal is pretty similar (except the Androscoggin show is sold out of exhibit spaces).Deal A.  If you sign up for exhibit space in Bangor, or a sponsorship or ad in the conference program for either conference, we’ll give you 25% off the regular rate cost (that’s even better than the Early Bird Rate, which ended a few weeks back).  In Bangor, the savings on a $399.00 exhibit booth will be $100.. so the cost to you is only $299.00!

Deal B.  If you sign up another person to buy an ad, exhibit space or sponsorship at the same time as you’re buying your own ad, exhibit space or sponsorship, we’ll give them 25% off the cost, and give you 33% off! (Now that’s sweet.)

Deal C. If you’ve already bought your exhibit space, sponsorship or ad, and can sign up another, equivalently-priced (or more expensive) space, sponsorship or ad, we’ll give them 25% off their cost and we’ll refund you 33% of whatever you’ve already paid.  (You must already be paid in full.)

Remember, these deals are for 48 hours only, and will not be available on the Eventbrite website; you’ll have to call me directly with a credit card (or arrange to hand-deliver a check or cash over the weekend).
